A gunman who killed two people and injured a third at Duck Creek Kitchen + Bar was under a restraining order, but still allowed to possess firearms, after he threatened his former boss.

Brown County Sheriff Todd Delain said Monday that Bruce K. Pofahl shot and killed I. J. S, 32, and J. T. B, 35, and seriously injured 28-year-old D. M. in an attack Saturday that began at the restaurant inside the Radisson Hotel & Conference Center. The hotel is attached to the Oneida Casino in Ashwaubenon.

Police shot and killed the 62-year-old gunman outside the building.

Pofahl was fired from his job as the restaurant's food and beverage manager earlier this year. He was not allowed to be on the property.

According to court records, Brown County Court Commissioner Phoebe Mix granted a temporary restraining order against Pofahl on March 9 on behalf of a restaurant employee who previously supervised Pofahl.

The employee, in documents filed that month, said Pofahl sent her threatening text messages and emails over the course of a few weeks that included pictures of her home and threats against her family.

Pofahl made comments like "time's up" in the messages, according to the employee. She said the behavior continued even after police contacted him multiple times. Hotel staff were also aware of the situation and shared her concerns.

The employee said Pofahl had been fired "for a few things, including harassment."

Court Commissioner Paul Burke granted a permanent restraining order with the employee on March 23, but records indicate that the court did not find "clear and convincing evidence that the respondent may use a firearm to cause physical harm to another or to endanger public safety."

Pofahl did not attend the hearing after telling court officials in a letter that he had concerns about COVID-19 safety at the courthouse.

"Pursuant to COVID pandemic criteria, I am a member in the vulnerable population having high blood pressure and diabetes," he wrote.

Newspaper archives indicate Pofahl had a long history in the hospitality industry. A 1995 article in The Detroit Jewish News identified him as a food and beverage director and executive assistant manager for a Radisson hotel outside Detroit.

He also worked at hotels in Naples, Florida, and Asheville, North Carolina, according to the Fort Myers News-Press and Asheville Citizen-Times.

It's easy to say this when it comes to gun violence. Even as an American, I can understand that completely. However, at least for a 6 year period from 2009-2015 we weren't the worst of the world, and we certainly weren't alone. I'm sure it has changed, perhaps significantly since 2015... but I know we still aren't the worse. Brazil takes the "trophy" for that.
