She's comparing falling off of a bar stool to rape? Yikes. Not even close. "I got so drunk last night that I fell off my bar stool and threw up in the parking lot." "I got so drunk last night that I got raped." Not quite the same thing. Saying that a woman is asking for rape is like saying she should be raped. There's a drunk woman walking alone. Whose turn is it to do the raping?

I agree its common but the reason people can sue is because it shouldnt be. Its up to the local council/government to maintain the roads and pavements. If the sate of a road has eroded to the extent where it could cause injury then its the resposiblilty of the council. Im not saying you shouldnt pay attention, you should make every effort to keep yourself safe but the biggest factor in this example would be lack of maintenance and not the awareness of the injured party not really the point was the same. Had the cyclist been looking more attentively he/she wouldnt have been beheaded right? |

I still think it's a bad analogy. Rape is an aggressive act - not a passive act; or act of blatant disregard for personal safety on the part of the victim, in most cases. |
