$4M settlement reached in teen's death

MILFORD -- The estate of one teenage victim in a crash with a Milford police cruiser has settled its lawsuit against the city for $4 million, court documents show.

Probate Judge Beverly Streit-Kefalas approved the settlement to the estate of Ashlie M. Krakowski on Nov. 26. Krakowski and David Servin, both 19 of Orange, were killed early on June 13, 2009, when the car Servin was driving collided with a Milford police cruiser driven at more than 90 miles per hour by former Officer Jason Anderson.

Anderson, who was returning from a mutual aid call in West Haven, broadsided the couple's car on the Boston Post Road in Orange. Anderson, 37, was convicted on Nov. 7 of misconduct with a motor vehicle and reckless driving. The jury found him not guilty of two counts of second-degree manslaughter. Anderson, who was fired from the Milford police department in December 2009, could get up to 10 years in prison when he is sentenced Jan. 16.

The young woman's estate will receive $2.8 million after expenses, including $1.2 million in legal fees, are deducted, according to court records. The city through the Connecticut Interlocal Risk Management Agency, its insurance carrier, will pay $3.5 million, and Servin's parents will pay $500,000.

Servin was driving Krakowski's car when the crash occurred. Anderson's lawyer, Hugh Keefe, had sought to introduce evidence at the former cop's trial that Servin and Krakowski had been drinking and that Servin had marijuana with him.

The probate court filing indicates that the Servins' insurance company will pay on their behalf. Frank and Susan Servin accepted a settlement of $2.5 million in March in their wrongful death suit against the city and the former officer on behalf of their son.

Ken Krakowski and the Servins could not be reached for comment Thursday. John Wynne, the lawyer for the Krakowski estate, did not return a reporter's phone call.

CIRMA is an insurance pool managed by the Connecticut Conference of Municipalities. CCM spokesman Kevin Maloney said Thursday that the agency doesn't comment on settlements.
