Zodiac - you are defining first degree murder. This may certainly fall under 2nd degree murder for depraved indifference. When someone is saying they can't breath and you continue to choke them, there is an argument that an extreme indifference to human life is being evinced. Especially with so many other cops around and this particular suspect not fighting back.

To be fair, most cops only have basic training in firearms and hand-to-hand. I am a competition shooter and run circles around cops when it comes to shooting. The only exception is the few SWAT guys that shoot with us.

Not all murder has to be premediated. Youre describing first degree murder. Second degree murder is a non-premeditated killing, resulting from an assault in which death of the victim was a distinct possibility. When you have someone in a police department banned chokehold and the person is exhaling out "I cant breathe", death is a definite distinct possibility in that situation. Also there is 3rd degreemurder. The killing must result from a defendant's conduct involving a reckless indifference to human life and a conscious disregard of an unreasonable risk of death or serious bodily injury. An example of this is a 2007 law in California where an individual could be convicted of third-degree murder if he or she kills another person while driving under the influence of alcohol, drugs, or controlled substances. Then you even have 4th degree murder which is murder committed by an accomplice during the commission of, attempt of, or flight from certain felonies. At least know what the fuck youre talking about before trying to sound like some sorta smart ass |

you have never been in a true choke hold you can't talk like he was. That man was a ticking time bomb but the choke hold was wrong but was not the only contributing factor, the person being arrested was worked up so any fighting is not healthy. I would like to ask when and what do you do with a huge man that won't comply? stunt gun= heart attack that choke hold with him talking he could breath, I know as I fight MMA but he was resisting panic made it worst blood pressure went up heart attack. frankly I believe the police were calm but when taking down someone of that size you need to use overwhelming force, its so easy to judge from behind a computer, they will settle this and hopefully the family will make good decisions with the money and start a better life |

Well, the death has been ruled as a homicide by the medical examiner, stating it was caused by "the compression of his chest and prone positioning during physical restraint by police". His asthma and heart disease is also said to have contributed his death. Over to the NYPD then perhaps.
