You have a gun. You can shoot a person in the leg, you can shoot them in the shoulder, you can shoot them in the fucking STOMACH, ANYTHING to incapacitate them. Yes, there is the chance that you might strike them in the femoral artery and accidentally kill them, but there is evidence that he was attacking you and that you were not necessarily aiming to kill, only to incapacitate, and death was merely coincidental.

However, taking the time to pull out a gun and aim at someone's head is a completely different matter. That is a deliberate kill shot.

As someone who actually is trained in use of force and sat through many many hours of class in regards to this matter…shooting to incapacitate is made up nonsense. The courts do not take into account and not do they make the distinction of you deciding to shoot someone in the face or the leg. There are only two charges (of different degrees), murder or attempted murder. Dying is the only circumstance that changes the difference. You can die just as fast if not faster by shooting someone in the league verses shooting someone in the torso. Also you say stomach…I’d rather get shot in the lung than get shot in the stomach…the aorta runs through that region as well as your liver, intestines, and spine. Besides sounding shitty…people usually recover really well from a sucking chest wound verses a lower abdomen shot.

Not in this particular instance.

The black dude was already winded, already on the ground.

The Asian with the gun could have just pointed the gun at him and commanded him not to move while telling his friend to call the police, or he could have called the police himself, or he could have told the cameraman to do so.

Since the black man was already in a seated position, Asian could shoot him in the abdomen as someone suggested, or in the legs.

Asian guy had options; he deliberately went for a kill shot.

The courts tally up all of the circumstances and whether there was ample time or resources for the "killer" to avoid having to take a life. As I just stated above, these guys had an embarrassment of alternatives.

One caveat, though... I don't think that a civilian is generally allowed to use a weapon to force compliance from someone else or to intimidate them. If you don't intend to shoot your target, best to not draw at all.

I read that this was possibly a case of mistaken identity. The black guy supposedly owed the Asian guys money. They beat him up and shot him twice when he denied being the person they were seeking. Apparently, the police in Philly confirmed that the black guy is pediatric technician with no criminal history and was at the wrong place at the wrong time.
