If the DA knew that the Judge couldn't or wouldn't instruct the jury to consider lesser charges, then the charge of 1st degree was most likely a play at acquittal.

I've got a feeling there is some kinda law that allows her to do this... The guy that got shot thinks hes just there for a free money ticket... basically by him not obeying he was essencially walking away with a but load of their money... as a law abiding person that offers this service it is probably allowed to shoot them because they are basically a criminal who you set free and when they start to break the law again they are your responsibility so by shooting him she did so out of public safety and get her money back from the pos .

Several people in this thread were correct, the first degree charge was well played, and the jury couldn't find her guilty of that so they acquitted her. The family of the deceased is planning a civil suit though.
