Police need reasons to believe a suspect is dangerous before firing a Taser and can't use their stun gun simply because the person is disobeying orders or acting erratically, a federal appeals court ruled Monday.The decision by the Ninth U.S. Circuit Court of Appeals sets judicial standards for police and for people who claim they were victims of excessive force after police hit them with a Taser dart. "The objective facts must indicate that the suspect poses an immediate threat to the officer or a member of the public," Judge Kim Wardlaw said in the 3-0 ruling. Though stun guns may offer a valuable, nonlethal alternative to deadly force in defusing dangerous situations, Wardlaw said, they inflict a "painful and frightening blow" and must be used only when substantial force is necessary and other options are unavailable. "It's a significant use of force, not like cuffing someone or using pain compliance or pepper spray," said Eugene Iredale, a lawyer for a San Diego-area man who was Tasered by a police officer who had stopped him for not wearing a seat belt. Okay, I don't see why he got out of his car to start with, but I also don't see why the cop was being such a jackass. Whenever you are in this situation, you have the right to know why. The cop has to give you a reason. As for the cop, just listening to him made me want to beat the shit out of him. As for the kid, next time don't get out of your car, some cops are paranoid. Last time I dealt with a cop I was cleaning a self service car wash at 2 in the morning. Apparently someone called in a robbery at the quickmart next door which was closed for the night. Well as im walkin around sweeping up trash 4 crown victorias swoop in on me and 5 cops get out with 3 handguns, one twelve-gauge shotgun, and a goddamned M16 assualt rifle[with two magazines taped together so he could reload fast] all of there guns pointed at me telling me to get on the ground. I woulda shit my pants but my rear sphincter was clinched up so tight you couldnt of stuck a toothpick up it. They questioned me, made me sit handcuffed in the back of the patrol car while they searched my 1964 chevy pickup truck from top to fuckin bottom, every god damned nook and cranny. Then they let me go and wrote me a ticket for expired registration. Sorry i got off topic, the point is the only words outta my mouth were yessir and no sir. i follewed every instruction to a fucking t before they even had to tell me. And after they let me go the one cool non dick cop outta the bunch said that they heard there was a robbery and they wernt gonna play around cause one of there buddies had been shot and killed a few weeks before over a robbery.

yeah im 20 and I hate the fuckin cops but you know what, if you ever sit down or stand around and actually talk to one of em, i think you will find that 99 percent of em are really cool dudes I think they just get tired of being lied to all day |
