A member of the Jodi Arias legal defense team who was banned from visiting her clients in Maricopa County jails has been reinstated after her attorney and Arias' attorneys met with attorneys from the Maricopa County sheriff's Office and the County Attorney's Office. Maria De La Rosa, a mitigation specialist, works for Arias' attorneys and other attorneys gathering information that may convince a jury not to the impose the death penalty against defendants. She was accused of trying to smuggle contraband out of the jail after a visit with Arias. The "contraband" was a pencil drawing of a pinwheel that Arias wanted to include in her file with other pieces of her artwork. After a telephone conference Wednesday, the ban was lifted, but neither side entirely backed down from its version of events. De La Rosa's attorney, Dan Raynak, said, "They admitted it wasn't contraband." But Deputy Chief Sheriff Jack MacIntyre said, "Ms. De La Rosa was less than forthcoming about taking something out with her." Both of them had taken part in the same conference. Arias has been convicted of the brutal 2008 murder of her lover Travis Alexander, who was found dead in the shower of his Mesa home with a bullet in his head, a slit throat and nearly 30 stab wounds. But the Maricopa County Superior Court jury that convicted her of first-degree murder was unable to reach a unanimous verdict on whether she should be sentenced to death. A second jury will be picked starting Sept. 8 to make that decision in a retrial. The case received unprecedented international attention because of the salacious testimony, photographs and audio recordings that were streamed live over television and the internet. And Arias herself has been a magnet for mostly negative attention, especially because she is fond of speaking to the press. According to a motion filed Sunday by Arias attorney Jennifer Willmott, sherff's detention officers searched Arias' jail cell in the week before the contested visit by De La Rosa. The drawing was in her cell. De La Rosa met with Arias in a meeting room inside the Estrella jail on Feb. 26, according to the motion, and Arias gave a sealed envelope to De La Rosa to deliver to Willmott. The envelope was offered to detention officers for inspection but was not opened. De La Rosa was then questioned about the envelope, which was classified as legal papers. She offered it for inspection, it was opened and the detention officers took the pencil drawing. The motion notes that earlier legal envelopes were never opened. On March 13, De La Rosa was told by her neighbors that sheriff's detectives had been to her house twice that day. They returned the next day and questioned De La Rosa, then handed her a letter that said, "As a result of your actions you are banned from all MCSO Jails ... immediately." The letter went on to say that her clients, several of whom are also facing the death penalty, would not be able to claim legal privileges when they called her and their calls could be recorded. A disciplinary action report was issued on Arias by jail staff. In her motion, Willmott claimed that cutting Arias off from her mitigation specialist was a violation of her right to legal counsel under the Sixth Amendment. Willmott asked, that the court throw out the intent to seek the death penalty against Arias. Willmott also contended in the motion that the banishment was "intentional and purposeful harassment." A Superior Court judge ordered the various parties to come to a resolution. That resolution, like many rulings in the Arias case, was filed under seal. "I think they realized that they were not going to be successful in a court hearing and they reinstated (De La Rosa)," Raynak said. "She didn't do anything wrong." Neither De La Rosa nor Willmott would comment. |

Yes, it is embedded somewhere near mid-thread. It is a nasty gash though. As for Jodi, if I saw her and didn't know her history I'd say she's cute, but the way she offed the lover is just off the chain dangerous, evil, and revolting. That's like playing Russian roulette with all chambers loaded: you're going to lose that one. Someone called here a black widow, and I agree. Capital Punishment discussion within this thread (IMO): if the person is so violent to society that they offer an immediate threat, they should be put down, but not at the cost and extended legal battle (in some cases the legal arguments are plain frivolous). Why not have a judge panel that decides nothing but capital punishment appeals? Again, IMO, it is not fair to the victim(s), family(ies), or the convicted to draw it out for so long. There are some evil monsters that are too great a threat to society (and non-reform-able) to continue to allow to parasite the oxygen of the earth. And why do we have to allow the capital punishment to have a smooth transition to the next world? Why not make them go through the same treatment as their victims? My apologies for a soapbox moment. |
