i'm quite sure that if they make a deal with him to pull the death penalty off the table with him in effort to learn more about their motive for doing this. Deals like this are always made on paper making them official and 100% legitimate... so whatever the terms they are enforced and followed through.

Federal case would override. MA does not have the death penalty.
