It wasn't her kid, why should she care? Kid was being dumb and because of that she was injured. She deserves compensation. Why should she have to pay for medical bills caused by someone elses stupidity? I hope she wins.

Thanks for your concern. I'm fine and having a nice beer right now. Good you take responsibility for things. Many people don't and that is tragic. You are just as responsible for the actions of your children. If the boy had been an adult then you would have a point. He was a minor and a very stupid and naive minor. Not only is he dead and unable to stand a trial but even if he was alive she could not sue him. She would still be forced to sue his parents. Tort law and all that. Hopefully his parents had some sort of insurance. But if not they could lose their home or savings. That is sad also. I try to imagine how I would feel and what I would do if I was in the woman's place. I have no family. My parents and grandparents are dead. I am completely alone and if I was injured and could not work I would be FORCED to sue the parents. I couldn't sue the transportation since they did nothing wrong. That's how I see it. And I don't go round condemning people for taking court action even if they are wrong. If they are wrong they will soon find out. If anything, if I disagreed with the judge then that's another issue. When society condemns people for the lawful use of the courts then what should people do? I am glad anyone decides to take it to the court. Of course there are frivolous lawsuits. I hardly think this counts as such. Back to my beer.

She sued and won. They respondents appealed and the verdict was overturned. She appealed and she won a final time. It's over. She won.

even in such dire circumstances i could not bring myself to sue parents who had lost a child. it's just who i am. here in america, california specifically, i would still receive medical care, whether i had the money or not. the hospital would help me fill out forms to claim Medi-Cal. if i could not work, i could claim state disability, you are allowed to do so for an entire year and you can even be working on acquiring social security disability at the same time so that it kicks in when the state has ended. i would apply for whatever other benefits i needed, welfare, food stamps. i would go to my church, i would go to my friends, but i would never hurt a family who had just suffered that tragedy. i find it difficult to understand a person who can. *shrugs* i'm different.

Well, my point is that I feel the source of the problem should provide the initial restitution. Why should tax payers bear the burden of people who refuse to teach their chidren about how the world works. But I could take a lesson from you on using these same services. Since I paid into them to begin with. I will send you private email later. The beers are kicking in now and I need to give it up for the night. Cheers.

i'm sure they were good parents who taught their child to look both ways when crossing streets and how to pay attention to trains, etc. i think i must have told each of my four children a hundred times each not to touch that hot stove, but what do you think each of those children did? they touched the hot stove of course. i told my kids not to cross the road without looking, i still had to grab them back a few times. i taught them all about the stupidity of drugs, a couple of them tried it anyway. you can be a good parent and still have a lovely child who will make mistakes.

and accidents do happen. i stopped, listened, looked both ways, everything appeared to be clear. . . and i still got hit by a car when i crossed the street. fortunately, i'm alive to speak of this. i did give up the paper route for a couple weeks though. his train was delayed, another faster train overtook it and sped through the station earlier than it normally would have. when the kid heard the train, it's thought that he believed it was his train slowing down as it came into the station. i wonder if he had his umbrella up and it was blocking his vision. anyway, sometimes shit just happens. it sucks but it's true. you just have to roll with the punches. you don't go and kick someone else just cause you got a raw deal.

yeah, shoot me an email or private message. i'm pretty good at working the system. i had to do it as a single mom, and again when my husband had a stroke eight years ago. i'll be online tomorrow afternoon. until then, sleep well.
