The guy's lawyer has a completely shit argument. That's like saying that I was within my legal rights to physically assault someone because they were being verbally abusive in an effort to instigate a fight. Under those circumstances, I would be arrested and charged with simple battery at the very least and the verbal instigation would do nothing to win me an acquittal. Not to mention the fact that she was no longer instigating once he was able to pass her. At that point, he chose to prolong whatever prior interaction there had been between the two of them up until then; beyond that, it was his own careless operation of his vehicle that caused him to lose control and endanger the lives of other motorists. I hope he found himself a cheap lawyer, because evidently he's also stupid enough to be wasting his money trying to mount an effective defense. |

Depends on what they can charge him with. I can easily see careless operation, obscene gesture, and reckless endangerment as being on the table. The first two are misdemeanors; the third can range from misdemeanor to felony and is defined here as follows: "Reckless endangerment is a charge that can be filed against people who engage in activity with dangerous consequences that could be foreseen, with a disregard for the danger involved. This charge may be a felony or a misdemeanor, depending on the specifics of the situation. It can also be combined with other charges. In situations deemed reckless endangerment, people do something that they know is dangerous, and they do not exhibit any thought about the potential consequences of what they are doing. They willfully behave in a way that is wanton or reckless, putting other people at risk. No intent to injure or kill is required; it is enough that the person knew an activity could pose a threat and chose to do it anyway. One example could be firing a weapon out the sunroof of a car. The person firing the weapon would be aware that there is a chance that someone could be hit with a bullet, potentially putting people in the area in danger. If someone is injured or killed, the person can be charged with a felony, because the use of a deadly weapon such as a gun in a reckless endangerment case upgrades the charge to a felony." The added emphases are mine, to illustrate the analogy between what I said about this asshole in my previous post/rant and the above layperson's definition of the charge. Just look at his face in the video and his mugshot in the HLN clip: he's a fucking mo-ron. My guess is that he'll get about 2 or 3 years probation, which he will hopefully violate into some jail time through some sort of future stupidity. |

I find both drivers behaviors inappropriate.. The truck driver was tailgating while the idiot was recording it in the passing lane. Lucky for them it could have been a lot worse.
