Re: Family Awarded $90 Mil After Kid is Hit by Car
What happened to the 17 year old? And was the driver drunk or something? Or did they freak out after hitting the girl and lose control after over correcting? Also, DS, I don't know how to move the info up. Can you help? |

Re: Family Awarded $90 Mil After Kid is Hit by Car
I believe $90 mil is way too much, but if the bus driver was supposed to be picking her up on her own side of the street, then they have a case. Having a group of teenagers cross the street to get to the bus rather than just pulling over to the other side of the road causes way too much risk for the group since they could easily be distracted. The driver that hit them though is who should really be sued. I wonder if the bus' stop sign was out.

$90 million certainly isn't going to bring their daughter back, christ it's just an accident that's gone terribly wrong. But you can sue for expecting a 13 year old child to cross the road? crazy. I say fair play to the family as well, who wouldn't really take $90 million if legally your entitled to it? blame the system, not the family. |

Re: Family Awarded $90 Mil After Kid is Hit by Car
The schools need the money so badly. I think it's the fault of the two drivers. I still say, if you can't see a big ugly yellow school bus, even with no lights, and can't see the school, you don't belong behind the wheel of a motor vehicle! And an entire group of kids?!? Really Our busses have changed from the yellow lights and red stops signs, which used to be only on one side, to one on each side, to red & blue on top like police cars here. The stop signs light up red and I believe they may still have yellow flashing lights, similar to tall buildings so airplanes can see them at night. Most school busses are in service in daylight! |

Re: Family Awarded $90 Mil After Kid is Hit by Car
Remember , no one actually gets 90million. Its a figure kind of throw out there to show guilt. The state caps at 100,000. Maybe not even enough to cover expenses. This being a well established law, the family would have known going in. So they couldn't have expected a big pay out. This is a jury being sympathetic to a family for being wronged. Obviously the other driver was a fault. Obviously the kid should have been able to cross the road. However, the kid was placed in a position of danger by people who should have known better and had a responsibility to provide as safe an environment as possible. They KNOWINGLY failed at that. |

I thought there was a cap. But if there is, the jury shouldn't be allowed to name some ridiculous number that exceeds the cap. It's just silly. Might as well award them a bajillion dollars, if they're not even going to get it. Just seems weird to me.
