He didn’t. He had no safe egress and line of sight prevented him from seeing whole picture. To get into the car and escape to safety he had to cover himself so he did by firing until he was safe in his car and then escaped. Self defense.

Without previous context, it's hard to judge but I was thinking it had something to do with the first aggressor rule that California has. But then again, California does have a No Duty to Retreat rule as well. |
