If the brakes failed, it may not be the driver's fault. I don't know the laws in South Africa, though. Professional drivers in the U.S. have to do cursory inspections on vehicles owned by their employer and report any issues they can't resolve on their own, but after that the responsibility for the repairs lies with the company that owns the truck. If a vehicle is known to be unsafe, the driver may even be obligated to refuse to operate it until the known issues have been resolved. Of course, that can also cost the driver their job. Sometimes brakes just fail, regardless of regular inspections and maintenance. It's not always as simple as saying that the liability lies with the person who was behind the wheel when the equipment decided to go to shit. |

70mph? My Arse that truck was going faster than that, way faster...best bit is the dead wouldn't have known anything about it (well apart from the 3 who died later)!
