Either way, there should've been belts and operators should've checked all restraints. Clearly they didn't and he went up without it clicked in cuz he was too big.

fault is still on ride operator. Should've told him to get off.

I doubt it. Ride operating engineer was doing what he was trained to do, i.e. if the light is green and the harnesses are all down, he presses the start button. Ride operating engineer is not trained in bio-mechanical deformation / extrusion processes / fat shaming of Sasquatches.
