A self defense allegation wouldn't fly in most courts around the globe, dude desisted and was retreating giving his back to the owner he either got shot sideways on his torso (The worst kind of torso wound) or on his back. Almost an automatic 1st degree murder charge. |

Dude.....come on, lighten up with strong declarations. First degree murder requires premeditation and planning, lying in wait for the victim. This was manslaughter at most (ie no aforementioned thought....the dude showed up to rob him, he probably got scared, made a shitty decision and killed him. Didn’t plan it) |

That's a very broad stroke of the brush. It definitely doesn't fit the criteria for a 1st degree murder. And it varies state by state in the US as what is considered self defense. In Kansas it's defined as this - "A person is justified in the use of force against another when and to the extent that it appears to such person and such person reasonably believes that such use of force is necessary to prevent or terminate such other's unlawful entry into or attack upon such person's dwelling, place of work or occupied vehicle." The first guy fit that criteria in my opinion.. But let's say that I'm wrong. The guy behind guy #1 was reaching for his weapon as well. It could easily be argued that the owner was trying to hit guy #2 and took out guy #1 in the process. Guy #2 wasn't leaving until guy 1 was dead mid-air. And again.. In Kansas at least.. if you're committing a felony (Armed robbery) and anyone dies during the felony.. the armed robbers would be charged with that death. So guy #2 would actually be charged with..... you guessed it. 1st degree murder. Murica! |
