Have these turds been sentenced yet?
It doesn’t look like they are going to be because they aren’t guilty of anything.

The trial started on Aug 18th but the judge is considering a dismissal on the grounds that this is a self defence case clearly defined by Texas state statute.
There are several factors at play here that support this.

1) Texas stand your ground law states clearly that if someone says they are going to do grave bodily harm or threatens you with death. You can kill them if you believe them.

The meth head screamed several times that he was going to kill both men. He also made this threat in the immediate as well as a future plan of action regardless of police involvement. This would allow either man to justifiably stop that threat in protection of themselves or each other.

2) The constitution of the state of Texas allows for the carry of a long gun (rifle or shotgun) in open in public.
The son in this case was easily within his rights and can’t be charged with any menacing or brandishing. Regardless of the situation.

3) This was NOT a public dumpster and therefore the jackass who ended up dead was trespassing with intent to commit a crime. Dumping garbage on property that isn’t yours is absolutely a crime. You may think this is a weak argument but facts are facts. They told Ed the meth head repeatedly not to use the dumpster and to remove the mattress. Ed was to busy spending money on meth to get his own dumpster. Now Ed is dead.

4) Some has been made about the dad’s felony conviction. It doesn’t matter Texas law clearly states that a felon CAN possess a firearm as long as that felon has 5 years from date of discharge of penal oversight with zero infractions of the law. Another words five years from the day you are off of probation, parole or served your full sentence if you have not even so much as had a parking ticket you are restored your 2A rights. That is 100% the case with the dad.

If it isn’t dismissed and by some liberal scumbaggery these guys are found guilty their supporters have already set things in motion to get them a pardon.

You can make fun of how they look or how out of shape they are even their complete lack of self care or what the argument was about but the fact of the matter is here in Texas you don’t get to bow up and threaten others, bully people around and threaten to kill them without consequence. Because in this state we all understand you may be bigger louder and more violent but there is one thing that will equalise the playing field quick as fuck.

This video shows the simplicity of that equaliser.

father and son duet could've shot in the legs, I don't get shooting to kill.
I can quickly surmise this is because you have never been in a gun fight. Also you are clearly unaware of the liability that comes with simple injury from a firearm.

Dead meth heads can’t sue you nor can they smoke more meth some night and decide to seek revenge. Because they are dead.

Ed the meth head has a wrap sheet that would span the state of Texas full of violent offences. From armed robbery to aggravated battery with a deadly weapon And felonious assault.
The world is a better place without him.
I am just thankful the meth head girlfriend has lost the poor abused kids to CPS. Maybe they will have a chance in life.

This is a perfect example of an abuse of stand your ground. An example of setting your own stage.

I mean this older suspect allegedly started the entire confrontation, and did so armed. And brandished his firearm while the deceased was still in his backyard and the suspect was in his.

According to witnesses the confrontation escalated very quickly after the weapon was drawn. So a jury could see that what lead to the shooting was not a dispute over a trashed mattress but a dispute over a neighbor pulling out a gun on a family.

As the deceased was accompanied by 3 or 4 members of his family at that time. 2 of which were children.

And stand your ground doesn't mean you can start an argument and pull your gun. And just continue the argument. One might say the suspect committed a felony when he pulled the firearm. Which takes away any stand your ground defense.

And the deceased did threaten the suspect. But the suspect was threatening the victim too. And only 1 had a gun. And then his son comes out with a shotgun. And they both seemingly threaten and just keep the altercation going seemingly hoping to get the victim to cross a threshold where they feel gives them cause.

And then you have demeanor. Stand your ground also states you must be in fear of you life or serious injury. I'm pretty confident neither suspect looked to be in fear at any point. They actually seemed to be enjoying it. Knowing they had it under control and were in no danger.

And then there's the woman's statement that after shooting her husband. And she runs to him . The father points the pistol at her head and orders her to lay down and the son does the same to the brother of the victim.

Which if true, is beyond fucked up. If I witnessed that I might have put them two down myself.

I'm all for the stand your ground laws. I'm a gun carrier. I have a pistol in the console of my vehicles. I conceal carry whenever I go certain places. I think it's a good important law.

I just happen to feel these two give people like me a bad rap. I think they make all gun owners look bad. Because it's about being a responsible gun owner. And only using or even pulling your weapon to save a life.

And when you are armed. It's no different than if you're a police officer. You should be held to a higher standard. You don't pick fights, or start altercations. You don't walk out of your yard to an alleyway to have an altercation.

Basically, you don't act like you're some fucking badass because your gun will do your fighting.

What if you got into a disagreement with these guys? And you both were like "fuck you, no fuck you" and they pull out guns.

Are you going to think, "well they got me, good for them". Or would you be furious? I know I would be furious.

I forgot one very important piece of evidence I'm certain will be 1 factor in their guilty verdict if that's what happens.

The deceased says "you pull a gun on my fucking kids you piece of shit"!. And the older suspect replys "go ahead, take your swing ".

There's several of these types of comments in the video. They are very telling and very important to show their mindset and their intentions.

That is the exact opposite of what stand your ground is about. You can't pull your gun and try to get the person to assault you. Which is what he was doing.

If I had to put money on this outcome. I think there's a 25% chance they both get manslaughter convictions. A 90% chance the father gets plead out on some felony where he doesn't go to prison but loses his gun rights.

And the son gets found guilty of murder. Because the son had no reason to shoot. The father had already fired. There was no immediate threat . And the shotgun may have been what actually killed him.

And the defense attorney is trying to get the video thrown out. Which I think is insane. He says it is an unfair version of events.

Which makes no sense. It's exactly what took place the last couple minutes before the shooting. The video is what makes it look bad, because it is bad.

And I hope they both go to prison. Simply because I believe they were wrong in handling it. So was the victim but he wasn't holding someone's life in his hand.

But just think if the state says this is OK. It's OK to start a fight or an argument. And then pull out a gun and force the other person to back down.

And all because these two wouldn't let them put a mattress in the garbage. And to them, it's worth killing for. I don't know for sure about the victim. I don't know if he was doing this because of the mattress because he more so seems to be doing it because of the guns being pulled. Which was incredibly stupid.

But I can understand his anger, because I would be angry too. How are you going to pull s gun on your neighbors? How do you live next to one another after that? It basically sets in motion this, or one of them being killed at some point in what would likely become a stand your ground off.
