It looks like Ernie was driving, yet he tried to get out through the passenger seat...hmmm...sign of uncooperation and escalation. He moves his arms as if he is reaching for something. Again, he was told to put his hands up...sign of uncooperation and escalation. There is a "21 foot rule" with cops which says that if there is a guy who you believed has an edged weapon or any weapon not necessarily a gun and you are in fear- shoot. They were definitely within 21 feet here. Ernie earned this one. Just do what the cops say and if they beat your ass anyways sue them.

Besides, if its true that Ernie was a gang member, had been locked up x3 and was in violation of his parole after he was involved in a domestic and he was alleged to be armed with a gun or knife...sucks to be you Ernie. Maybe your awful decision making process failed you.

My conclusion;
POLICE ALREADY HAD THE GUN DRAWN which gives him the advantage.by the time ernie tries to grab the assumed gun and load and aim and shoot.. police officer already have him.. but this situation police shot way too early. considering many of them have bullet proof vest. he should've at least wait while he had the gun on him. and see if he was gonna grab a weapon.!!

The cop yelled clearly and loudly enough and warned him that he would shoot. The guy made no attempt to put his hands up and he was definitely going for something inside his truck. I say justified in this case. You do not mess with armed cops who have told you they WILL shoot!

I do think it was overkill to shoot him when he was on the ground and I could see no reason to roll the bloke around on the floor to handcuff him. It seemed apparent from the grainy video and must've been more apparent to the cop when he was close up that the guy was no longer a threat. Maybe it's adrenaline that causes the over-reaction. But I would not have waited around to see what the bloke was going to pull out of the truck
