The driver should have been paying closer attention most definitely..but everybody today is in such a rush to get to nowhere...the mother crossed at a crosswalk..I always thought that at the crosswalk the pedestrian had the right away...we have all been in a situation where we weren't paying attention..it's just our good fortune we weren't the driver in a situation like this...as for the driver I feel sorry for her..she was stupid for not paying attention..I feel worse for the mother and child...innocent victims ..especially the child..a waste of life.. |

Not sure where everyone else is from, but my mom always taught me and my siblings to look both ways before crossing the road. Twice. It's true that the pedestrian has the right of way when inside of a crosswalk; however, what good will that do in a lawsuit when you're dead? Never assume someone driving towards you is aware, responsible, and sober. |

I have a car and while it is hard to avoid idiots crossing the road at un-predictable times, that driver had a good 30-40 feet to see her and brake. She was too busy fucking around talking to someone in the car. Distractions whilst driving kill as much as idiocy. |

The driver had plenty of time to stop, had she been paying attention. That being said... I live in Seattle, and pedestrians here think there is some magical force field protecting them if they decide to walk out into the road without looking. Most times, they don't look but you have plenty of time and space to see and stop for them. However a few of them aren't so lucky, and they will appear suddenly from behind parallel parked SUVs or big trucks, so you CANT see them. It does not matter whose responsible or liable for what... I mean, insurance and prosecuting-wise, sure... but otherwise, if you don't look both ways while crossing the road, you will get hit eventually. You could have prevented it by looking both ways. That's the point. End of story. There's nothing to debate about this really. Physics will always win. |

Unfortunate but not really her fault. the pedestrians shouldnt have crossed and expected a full speeding car stop for her
