Sorry, but the excavator driver had NO part in this. he stayed in his lane, and he ISN'T going that fast, considering the roads are empty, except for idiots. This is just Darwin. Lane markings exist for a reason. If you take the moped idiot out of the picture, and there was no accident, then the moped driver is the cause. |

For all he knew, there could have been someone crossing the road or another vehicle parked up. He should have taken the corner slower to ensure that the road was clear to do so. The moped driver was definitely also in the wrong. Just a stupid careless mistake.

I prefer to look at accidents the same as how an aircraft accident is analyzed. You take out factors that are only "possible" and look at the real causes. If the moped moron had not been on the road, and acted as he did, there would have been no accident. There was no one crossing the road, and from the excavator's perspective, there was no oncoming traffic, so neither of those factors played any contributing part to the accident. There were no unicorns playing in the road, and no evil clowns popping out from behind the bushes. It may seem harsh, but it is the only accurate way to determine cause, and chain of events. The Excavator driver did nothing wrong, and therefore contributed nothing to the accident, and therefore is NOT at fault in any way. Life can be harsh. |
