Most people look at the Catsouras incident and decide immediately whether or not they think the Catsouras family's wishes to protect their daughter's memory should be allowed to suppress the pictures. Protecting Nicole's image is, after all, one of the main reasons they give for suing to have the pictures removed from the web. However, genuine issues of freedom of the press come to mind. The First Amendment provides for freedom of the press, and any materials can be printed and distributed unless they are deemed to be pornographic and without redeeming social value. The Catsouras family just states that their privacy was invaded. They insist that their other children were traumatized by seeing the pictures and that the whole family is now afraid to go onto the Internet. They assert that other children who saw the pictures were so traumatized they are now in counseling. They believe the California Highway Patrol leaked the pictures, and are suing the CHP and thus the state. In reality, however, the Catsouras pictures DO have redeeming social value. They cannot help but be a warning to pay attention and maintain a reasonable speed. The Catsouras rights were not violated: the victim is not identifiable and in any case, even identifiable photographs can be utilized in the media once an individual has become a public figure. In America, when someone breaks the law by stealing a car, causes an accident on a highway (or in this case, on a toll booth) and requires the intervention of the state in a public area, they become a public figure, and they lose their right to privacy. The Catsouras family should not allow their vast amounts of money to circumvent the Constitution, no matter how devastated they personally feel by the results. Regardless of how anyone "feels" personally about the grief of the Catsouras family and the gore of the pictures, we must uphold the Constitution. Money should not be allowed to buy the American legal system. |

I understand how they may be outraged by this. and believe me I would be outraged too. But seeing these sorts of things make the masses think...If they have any type of heart at all...it will make them think about the importance of their childrens saftey....and if some teenager are really difficult to get through to.....then this sort of thing may open their eyes and watch their actions.....drive safley and such. My condolences to the family..... |

You know who I feel sorry for in this situation? The insurance agent who sold the policy to the dad... I bet his bonus check really sucked that year. Just think? His poor kids didn't get that Playstation 3 they wanted for Christmas. |
