Houghton County Prosecutor Doug Edwards cleared Deputy Mark Bukovich on Wednesday, in the shooting death of an Osceola Township man, that occurred three weeks ago. He said that after reviewing evidence in the shooting case, he determined that Bukovich didn't break the law when he pulled his gun and fired on 41-year-old Dan Bailey, killing him. I thought Mr. Bukovich was very fortunate to get out this situation alive, said Edwards. He did what he had to do, what absolutely had to do, and that was take him down. Unfortunately, Mr. Bailey died. Houghton County Deputy Bukovich was responding to a complaint in Tamarack Location when he was beaten by Bailey with a golf club, forcing him to draw his gun and kill Bailey. The incident took place on September 17th, outside Bailey's home on Sixth Street, outside of Calumet. A patrol car dash camera shows Bailey repeatedly hitting Deputy Bukovich with the golf club, knocking him to the ground. That's when Bukovich fired. You're talking seconds, said Edwards. Mark Bukovich didn't have a choice. In fact, it's my understanding he tried to taser him, but he couldn't. And that's the reason he shot him. If he had been hit in the head, he would have died. Edwards says he hopes closing the case will bring some closure for Deputy Bukovich and Bailey's family, the suspect who died at the scene of the shooting incident. We spoke with Bailey's brother-in-law, who directed us to his father. He is the family spokesperson. He didn't answer his phone. Officials at the Michigan State Police Headquarters in Lansing will review it, before they'll release it. Deputy Bukovich was shot in the foot during the struggle. He's currently off work, on worker's compensation. He is expected to recover in six months.

The guy is shot many times, you can see him reacting to getting shot but he keeps swinging away

The kill shot to the suspects face hits his reading glasses and sends them flying

8 months later:

"I was pretty shocked at first at just the color of his skin," said Deputy Scott Leonard. "He looked ghostly. You could tell he was in shock."

Bukovich remembers it well. He was responding to a domestic disturbance call in Calumet Township.

He says 41-year-old Daniel Bailey came out of his home, repeatedly hitting Bukovich with a golf club in the back and wrist, knocking him to the ground. And then, he says, Bailey aimed for his head.

"I knew at this point I'd already taken a couple of blows and I was injured," said Bukovich.

"I knew that if I did not draw my weapon and defend myself in the manner I did, this man was going to kill me.
And if not kill, he was at least going to critically injure me."

At that point, Deputy Bukovich shot and killed Bailey. Shortly afterward, officers arrived at the scene.

Besides the physical pain he feels on a daily basis, Deputy Bukovich is facing the fact that he may never put on a uniform again.

"There was a lot of injuries to my ankle and foot," he said, "but right now the injuries that are going to keep me from returning to work is nerve damage. I cannot run or climb steps."

And that's difficult news for members of the Sheriff's Department, who say Bukovich, just five years shy of retirement, is one of the best officers in the area.

It's been a struggle for Bukovich to adjust to life without work, but at least for the last eight months, he's been able to spend more time with his family.

"So, there's ten things I can't do," said Bukovich. "There's still 30 things I like to do, and I'm going to look at it that way."
He did the right thing.

Definitely a good shoot. Its unfortunate that Mr Bailey thought it was necessarily to attack an officer like that. Hopefully the officer can return to work.

And this is why I don't blame cops at all for immediately drawing and shooting on some dickhead with a baseballbat, knife, or other weapon. This cop was more than a good cop to take a few blows before taking out his piece.

You cant see a guy swinging a huge 9 Iron and hitting the Officer repeatedly even after being shot multiple times?

I hate the criminal loving liberals who say "Why did he shoot him? It was just a little tiny golf club, or a little baseball bat, the Cop should have just talked to him and reasoned with him"

Anybody who thinks a baseball bat or 9 Iron cant kill an Officer is insane


I want to post this video on that stupid memorial page for that scumbag Joey Carl where all his "friends" say the officer was wrong to use his gun and a baseball bat cant kill you and blah blah blah....
