Man with Gun Shot by Cop After Standoff Outside Burritos Restaurant

Video released Thursday by the Naperville Police Department of a police officer who shot a man during a January standoff shows the officer pleaded with the man to drop his weapon before the shooting occurred.

The video from dashboard cameras sheds light on the incident in which a 27-year-old man with a gun confronted officers about 10:30 p.m. Jan. 23 in a parking lot outside the Los Burritos Tapatios restaurant at 1232 W. Ogden Ave.

The man, dressed in a dark hoodie and sweat pants, is seen walking from inside the restaurant to speak with officers who responded to calls about a person who was acting erratically and had asked a motorist at a gas station across the street if he could purchase Xanax.

After the man exits the restaurant through the front door, the video shows him wave a gun at an approaching officer, who immediately backs off and tries to take cover behind a vehicle.

At the same time patrons and staff inside the restaurant can be seen running to the back of the building.

For the next three minutes, the officer can be heard on an audio-video recording pleading with the man to put down the gun he was holding to his head.

“Drop the gun. Talk to me,” the officer said.

He asks for the man’s name and then offers a series of questions and affirmations trying to de-escalate the situation. At one point the man falls to his knees.

“Nobody believes me,” the man cries out.

“I am here. I am here to help you. OK?” the officer replies.

“What’s going on tonight that’s causing this?” the officer asks. “It’s not over. It’s never over. Things can always get better.

“Alex. Listen to me. Let me help you. Give me a chance to help you. Please,” the officer pleads. “You’ve got to drop the gun, and I can help you.”

The video then shows the man stand up and turn the gun on the officer before the man falls into the snow-covered parking lot.

Audio records what appears to be seven gun shots.

The man survived and was taken to the hospital for treatment.

An investigation into the shooting is being handled by the DuPage Major Crimes Task Force and DuPage County State’s Attorney’s Office, which took over the case because a Naperville officer was involved.

Police Chief Robert Marshall said the officer will remains on administrative duty until the investigation is concluded.
