Cop Suspended After Shoving a Train Commuter into the Wall of a Cell

Aus. CCTV footage shows a police officer shoving a train commuter into the wall of a cell and then throwing him to the floor after the man failed to show identification.

Dean Bradley Anderson, 40, a senior constable once commended for bravery, is likely to lose his job of 13 years after he was found guilty of four counts of assault in Melbourne Magistrates Court.

Anderson was found by magistrate Elizabeth Lambden to have assaulted commuter Anton Perry on December 13, 2012 in a police cell at Flinders Street station.

CCTV footage of the assault was released by the court late on Thursday. The footage shows Anderson grabbing Mr Perry's left forearm and jerking him around, before shoving the commuter into the wall.

The police officer then throws Mr Perry to the floor and straddles him, putting his hands on or near his neck. Anderson later forces Mr Perry's head into the wall when the man was seated inside the cell.

Anderson, a member of the Police Association executive, pleaded not guilty to the charges and argued in court he took evasive action in the fear Mr Perry was about to spit on him.

Anderson told the court last month he had been spat on previously and had undergone blood tests. He was mentoring three protective services officers at the station when he took Mr Perry into the cell, after the commuter had failed to give his name when asked and did not show a travel pass.

But Ms Lambden said Anderson's actions were a case of a police officer acting beyond his powers. "What you did was not because of a belief that the complainant was going to spit, but was more brought about by a loss of temper with his resistance [to] complying with your demands," she said.

Ms Lambden did not record convictions against Anderson, but ordered him to serve a community corrections order which involves 150 hours of unpaid community work.

Anderson, who has been suspended without pay for 14 months, lodged an appeal through his lawyer. The court heard he would likely lose his job because of the guilty verdict.

How was this guy resisting in anyway? the cop grabbed his arm and the guy turned around and didn't even move. no need for all that..

well, doesn't look like that to me, at all. it looks like he must've said something when he was getting cuffed which set the cop off into a rage.
