She had it coming and it was just a slight tap anyway. She was so sloppy drunk that she needed little, if any, help to fall over. You want to fight a cop? You want 'equality'? You just got both. She's just looking for a payday. |

Ok cop haters (and Canadians First off she intentionally kicked the officer in the shins...that's battery on a peace officer. Now depending on jurisdiction that can be either a misdemeanor or a felony...I don't know what it is off the top of my head in RI (someone else can look that up). Now...in looking at the fairly short video, and I wish it showed more, I can see the bad girl kick the officer and I can see him kick ("foot strike" in cop speak) at her and only slightly actually connecting with his toe to some point on her head...at which point it appears she fell over and passed out...from the booze...not the kick. In any case...striking a handcuffed suspect is usually prohibited (by law and by policy) unless there are fairly dire emergent circumstances. This case will hang on whether the officer acted out of a reasonable (based on a reasonable man or officer) fear that the handcuffed suspect presented a significant enough threat to him, his partner's safety/security, or the suspect's safety/security. I personally think he reacted out of simple reflex and was more pushing her with his foot. I think if he would've intentionally kicked her he would've stomped her with the sole of his boot rather than use the toe. In any case, he should have used his arms to hold her down rather than kick at her or kicking her...it just looks tacky to kick someone who's handcuffed. I don't think he made the correct tactical decision and should have used his arms to subdue her. Boot strikes are a lawful and useful technique for officers in certain situations, just not this one. The officer screwed up and should be punished and retrained...not prosecuted. The female drunkard was partially to blame for the situation and since she wasn't injured I see reason for a prosecution, other than grandstanding by an elected DA. It's overkill and will undoubtedly lend credence to a future civil lawsuit...again costingbthe taxpayer even more money. This whole incident should have been handled internally within the police department...prosecution was stupid and expensive. This whole case will come down to a jury...and whether the drunk female can overcome her being a less than ideal victim and how much respect the local police have within the community. I think with the right legal counsel the officer has a good chance of getting off. |

I'd like to see the evidence that he even connected with her head. Were there any cuts, marks, contusions, boot prints, etc? I bet there aren't and the prosecution is relying solely on the video. Big mistake if that's the case. |

Yup. If she assaulted him, she should have been charged for it and answerable for it in Court. She was already handcuffed and on the floor. She was in no position to cause harm. IF he needed to ensure that she was not capable of kicking anybody again, he should have restrained her legs or simply stood back out of harms way, or taken up position at her back to control her. Kicking her in the head prevents nothing. He is there to enforce the law, not execute punishment. The use of force chosen in this case was inappropriate and unreasonable.
