Utah Man Sentenced in Homeless Man's Shooting

Dalton James Aiken, 28, was sentenced in June 2019 to 16 years to life in prison in connection with the shooting death of Brian Racine at a homeless encampment outside Ogden, Utah.

Racine, a 28-year-old homeless man originally from California, was sleeping at the encampment when Aiken shot him once in the head on August 16, 2018. Aiken had gone there with his friend Cory Fitzwater and later told police they were on a mission to harass homeless people.

After Fitzwater and Aiken were jailed following the shooting, each made a separate phone call accusing the other of being entirely responsible for the killing.

Prosecutors allege Fitzwater bribed multiple uninvolved inmates to approach police with fabricated accounts that Aiken had confessed to killing Racine, had acted alone and had said Fitzwater was innocent.

Aiken was convicted, while Fitzwater's trial was only beginning after significant delays caused by Covid and scheduling difficulties involving prosecutors and defense expert witnesses. Fitzwater was charged with murder and obstruction of justice.

Fitzwater also unsuccessfully sought compassionate release because of a particularly bad Covid outbreak at the jail where he was being held. Prosecutors argued the community would be safe only if the alleged murderer remained jailed, and cited his alleged attempts to "manufacture evidence, influence witnesses and obstruct justice" in the case.

The video is a police interview-room recording of Dalton Aiken and runs about 28 minutes. It presents the interview itself, without narration or a presenter.
