Ryan Waller Questioned by Phoenix Police After Being Shot in the Head

Richie Lee Carver and his father, Larry Lloyd Carver, were convicted in a Phoenix, Arizona, home attack that killed Heather M. Quan and left her boyfriend, Ryan Thomas Waller, with a gunshot wound to the head.

Waller, 18, lived with Quan in the apartment. Richie Carver, a former roommate of Waller's, and Larry Carver went there on December 23, 2006, seeking revenge over an earlier altercation. As they forced their way through the doorway, Richie Carver shot Waller in the head and left him for dead. The men entered the residence, shot and killed Quan, apparently because she was a witness, and took weapons and a computer.

Waller survived and remained in the apartment with Quan's body until police found him days later. Police initially treated him as a suspect in Quan's death rather than as a victim. His family, which released the recorded interview, dated it December 26, 2006.

The recording opens with an officer photographing Waller and taking swabs. Waller repeatedly says he wants to sleep and asks to go home. An officer tells him he is not going home and suggests that a concussion is why he should not sleep. After being read his Miranda rights, Waller says he understands them but has no idea why he is there. He provides his name and Social Security number, says he completed eighth grade and did not graduate, and repeatedly answers that he does not know. Asked about a girl named Heather, he says he does not know her last name. His answers remain confused and halting.

Waller's head wound had not been treated. Prosecutors later said he remained conscious, identified his assailants and told detectives that Richie Carver was his former roommate. Waller was subsequently hospitalized, had part of his brain removed and lost his left eye. He died January 20, 2016, at age 27.

Richie Lee Carver was convicted in June 2008 of felony murder, burglary, aggravated assault and misconduct involving weapons, and was sentenced to natural life in prison. Larry Carver's prosecution followed the passage of Heather's Law, an Arizona measure that amended the marital privilege statute to compel testimony from a defendant's spouse when that spouse had voluntarily given police information about the other's involvement in a serious crime. After a ten-day trial and about two and a half days of deliberation, a Maricopa County jury convicted Larry Carver on December 14, 2012, of first-degree murder, attempted first-degree murder, burglary and aggravated assault. Sentencing was set for January 25, 2013, before Judge Susanna Pineda, and the county attorney's office said he could spend the rest of his life in prison. The sentence actually imposed has not been publicly reported.

The video is a police interview-room recording that runs about 65 minutes. It shows the interview itself, without narration or a presenter.
