Antoine Lee Bynum Convicted of Second-degree Murder

A jury convicted Antoine Lee Bynum of second-degree murder and he was sentenced to life in prison for killing his longtime girlfriend, Remmi Goyens, on December 20, 2011.

Bynum claimed Goyens had "put a voodoo trick" on him, resulting in voices in his head that told him he could have been an NBA star or an NFL player. After multiple incompetency determinations, Bynum was declared competent in August 2016. At his August 8, 2016, trial, he admitted killing Goyens but raised an insanity defense. The jury convicted him of the lesser-included offense of second-degree murder.

On April 26, 2015, the day before trial was initially scheduled, Bynum's counsel filed a notice of incompetency. After considering reports from two court-appointed experts, the trial court found Bynum incompetent and committed him to the Department of Children and Families (DCF) for treatment at a state hospital under Florida criminal law.

Mental health professionals at the North Florida Evaluation and Treatment Center reported on August 31, 2015, that Bynum's competency had been restored. At his attorney's request, the court appointed another expert. At an October 22, 2015, competency hearing, no evidence was received. Although the court had not reviewed the expert's report, it found Bynum competent "based on the accord of [the expert], and based on the stipulations of the State and Defense."

Bynum appealed his judgment and sentence. On May 11, 2018, the Fifth District Court of Appeals remanded the case for further proceedings after the defense argued that the trial court had failed to "make an independent determination of [Bynum's] competency." The appeals court reversed only for a retroactive competency hearing and affirmed on all other matters.

The appeals court held that accepting the parties' stipulation about competency was not permitted, particularly when the trial court had not reviewed the expert's report. A court must independently determine whether a defendant is competent to proceed.

The retroactive competency hearing was held in Florida on August 3, 2018. The court found Bynum had been competent to proceed and issued an order rectifying its earlier error. Bynum is serving a life sentence.

The video is about 76 minutes of police interview-room footage. It presents the interview itself, without narration or a presenter.
