The international water navigation rules and aviation rules assign right-of-way to the boat.

USCG RULE 15 - International Steering and Sailing Rules - Crossing Situation
"When two power-driven vessels are crossing so as to involve risk of collision, the vessel which has the other on her own starboard side shall keep out of the way and shall, if the circumstances of the case admit, avoid crossing ahead of the other vessel."

USCG RULE 18 - International Steering and Sailing Rules - Responsibilities Between Vessels - Simplified Summary of Stand-on Vessel Priority List
  1. NUC Not Under Command (broken down)
  2. RAM Restricted in Ability to Maneuver (nature of her work)
  3. CBD Constrained By Draft (International ONLY)
  4. FISHING Fishing (Commercial) (NOT trolling)
  5. SAILING Sailing (Under Sail Only) (NOT under power)
  6. POWER Power Driven Vessel (includes sailboat under power)
  7. SEAPLANE
  8. OVERTAKING

USCG Rule 18(e) pertaining to seaplanes:
"(e) A seaplane on the water shall, in general, keep well clear of all vessels and avoid impeding their navigation. In circumstances, however, where risk
of collision exists, she shall comply with the Rules of this Part."

USFAA Regulations per 14 CFR 91.115
Amendment Number: Initial, Effective Date: 09/30/1963

TITLE: Right-of-way rules: Water operations.

SECTION RULE: (a) General. Each person operating an aircraft on the water shall, insofar as possible, keep clear of all vessels and avoid impeding their navigation, and shall give way to any vessel or other aircraft that is given the right-of-way by any rule of this section.
(b) Crossing. When aircraft, or an aircraft and a vessel, are on crossing courses, the aircraft or vessel to the other's right has the right-of-way.

Amphibious A/C have the right of way. Once they start their take-off run, they can't turn. It's the boater's responsibility to stay clear of the takeoff path and avoid the aircraft. I imagine this guy was drunk. It's gonna hurt a lot more when he gets the $200,000 bill for the aircraft. That looked like a DeHavilland Beaver. They may be over $300,000 now.
Oh, well. Smarter now!

The plane in question is a DeHavilland Turbo Otter not a Beaver.


Larger than the beaver. The original powerplant for these were the P&W Twin Wasp.

I do aircraft litigation. That bill against him will exceed $5.0 m, from passenger claims. Could easily go up if long term disability

I believe that they have an "Exclusion Zone" but the boat entered the zone, so the costs will end up being the registered boat owners responsibility & if he isnt insured, they will take everything he owns to pay for the plane. House, Car everything.
Expensive Trip !
Don't leave out ATC involvement. Here, that would be the pocket we all would pick. ATC warn anyone? What did ATC know, and when did they know it?
