The funny thing is that they toss that phrase around so much without understanding its origins - letters from Jefferson and company indicated that the phrase meant the same as 'let the punishment fit the crime' - meaning, if you steal a loaf of bread, you shouldn't be tortured for it etc...this also means that an unpleasant execution for a crime like his is by no means 'cruel and unusual' by the original intended definition.

I agree … if you live by the sword, you should die by the sword … Allen Lee Davis didn’t care about the people he raped and killed. I think he should have been put in a cage with 20 extremely horny guerillas, then half-electrocuted, shot through the pelvis, half drowned in his own vomit and then strung to a tree … or something. |
