Teens Returning Airsoft Gun to Store Killed by Off-duty Guard, Police Say

https://www.seattletimes.com/seattle...rd-police-say/

An off-duty, armed security guard shot and killed a 17-year-old boy who was trying to exchange an airsoft gun to a Renton sporting goods store on Wednesday evening, according to police.

The off-duty security guard, a 51-year-old man, shot the boy as he and two other teens were walking toward a Big 5 Sporting Goods store in a strip mall on Grady Way, according to court documents released Friday.

The Seattle Times generally does not name suspects until they have been charged.

The suspect told Renton Police Department officers he believed the boy was going to rob the store.

The surviving two teenagers told police they were going to the store to exchange or return a malfunctioning airsoft gun, as well as to get help with another airsoft gun they had.

The suspect had been waiting to pick up his son from a martial arts studio in the same strip mall when he saw three people walk in front of his car toward the Big 5 Sporting Goods store, the documents said. He told police he “conducts ‘overwatch'” at the strip mall because of crimes he’s witnessed in the parking lot.

The suspect said he saw one of the boys had what he believed to be a Glock, and believed the group was going to commit armed robbery, documents said.

He “felt like he did not have time to call 911, and that he had a duty to act to stop the individuals from hurting someone innocent, and to protect his son who was in the location next door,” police wrote in their report.

The suspect got out of his car and pointed his gun at the group, telling them to drop the firearm and put their hands up, according to the documents. The teen who was holding the gun threw it to the side, the suspect told police.

According to surveillance footage, the suspect then pushed the teen to the ground and straddled him, pinning him down.

The suspect told police that’s when he saw one of the other teenagers reach into his waistband. The suspect said he saw the victim grab the handle of a gun and believed he was going to pull it out and kill him.

The suspect then shot the victim “numerous times,” court documents said. King County sheriff’s deputies were coincidentally in the parking lot and responded within seconds. The victim died at the scene.

Testimony from the surviving teenagers and surveillance camera footage contradict the suspect’s statement to police, according to court documents. One of the boys told police the victim never removed the airsoft gun from his waistband.

Surveillance footage shows the victim backing away from the suspect with his hands extended showing nothing in them. The victim shows his left hand raised above his head and his right arm briefly lowering to his waist area.

“Immediately after [the victim] is seen, on video, with his hand on the waist area it is clear that he has been shot because he abruptly jerks his body away from [suspect] and falls to the ground,” police wrote in their report.

The teenagers told police they repeatedly yelled out to the suspect that the guns they had were BB guns. The suspect told police he believed the guns were real.

The man was booked into King County Jail for second-degree murder. A charging decision from prosecutors is expected on June 10.

Moral of the story, those who look for trouble find it.

They won't name the suspect, but I will: 51-year-old Aaron Brown Myers.

Re: Teens Returning Airsoft Gun to Store Killed by Off-duty Guard, Police Say

Myers reiterated to detectives that the teens would not follow his commands. It should be noted that Myers is not a uniformed law enforcement officer, and they did not need to follow his commands.

In Washington state, a citizen's arrest can be conducted to detain someone you see committing a misdemeanor or felony, like when store employees restrain a shoplifter.

Private citizens don't have the authority to detain someone or take them to jail for believing a crime could be committed. If a person detains someone they didn't see commit a crime, it could be considered false imprisonment.

Myers said he thought he saw a teen reach for something in his waistband, so he fired multiple times.

According to court documents, he stood over the teen on the ground and continued to fire.

Re: Teens Returning Airsoft Gun to Store Killed by Off-duty Guard, Police Say

As part of the charging decision, prosecutors said 51-year-old Aaron Brown Myers shot 17-year-old Hazrat Ali Rohani a total of seven times, including six times in the back. Prosecutors argued that Rohani could not have posed a threat to Myers since the teen was allegedly facing away from Myers at the time of the incident.

In newly released court documents, prosecutors said this was not the first time Myers chose to “intervene” when he believed someone was armed, and when that person had committed no crime.

"In March of 2022, the defendant followed a person carrying a metal object that he believed to be a gun from one store, through another store, and away from the second store, all because he may need to intervene and he might have to shoot the person," wrote prosecutors.

"In that case, because the defendant had called 911, trained law enforcement officers responded and were able to quickly determine that the person (Myers) was following did not have a gun and posed no threat, without anyone being hurt in the process."
