Memphis, Tn - At 17-years-old, Eduardo Marmolejo wouldn't by normal legal standards be considered an adult. But, as the alleged suspect in the heinous stabbing death of East Memphis private school principal Suzzette York, the former Memphis Junior Academy student could face criminal consequences befitting a person far older.

“The problem that the juveniles who are close to adult age face is can they be transferred and then will face very serious charges as an adult,” said Memphis Defense Attorney Steffen Schreiner.

Marmolejo's age and the high profile crime he's accused of committing could pose some special difficulties for any defense attorney who takes his case. At his juvenile detention hearing on Thursday, a judge, concerned over the confusion of whether or not the Marmolejos' had hired an attorney for their son, decided to order a psychological evaluation of the teenager. Although another juvenile court hearing for Marmolejo wasn't set it's expected his psyche evaluation might take up to two weeks.

“One of the first things that I do is have a mental evaluation done on the young man. Obviously, sounds like something is going on or some other factors that we're not aware of based on the reports in the media,” said Memphis Defense Attorney Arthur Horne.

Schreiner says the evaluation is key in determining how to charge the case, “Certainly a psychological evaluation as to the maturity or immaturity or any brain aspects that might explain this behavior you typically don't expect from a 17-year old.”

“His environment. His family situation. Whether there are mental issues. Those are all things that you would have to consider and I think the state would probably consider before making a determination as to charge him with just first degree murder,” added Horne.

But, if Marmolejo is deemed competent to be remanded to the custody of the state for a formal charge as an adult and a possible trial, that's when a defense attorney's work will truly begin, in dealing with the teen's alleged confession to the crime contained in an MPD affidavit.

“Confessions are easy to get out of juveniles for a variety of reasons. You're starting as a defense lawyer with your hands tied,” said defense attorney Mark Mesler.

“When faced with a juvenile confession, where was his adult guardian? When this confession was obtained, in order to give a confession, a confessor has to waive certain important constitutional rights,” said Schriener. “They're put in a very difficult position to make very adult decisions in an extremely high stress environment.”

“It seems like the younger the person the harder it is to understand that they committed a crime that's going to impact the rest of their lives,” said Mesler.
