A man who won £40million on a slot machine, only to be told by casino bosses it was invalid, has accepted £1million payout after taking the them to court.
Berhar Merlaku was offered a meal voucher at Casino Bregenz as compensation for the 'software error' in the slot machine, but refused to accept.
The 26-year-old demanded £5million from the entertainment palace in compensation, but told judges at Feldkirch, Austria, he had accepted a lesser amount in order to help his disabled son.
Mr Merlaku, who hails from Switzerland, claims that his infant son Erion's cleft palate is a direct result of the stress his mother suffered during her pregnancy, something which he is adamant was caused by the casino ordeal.
He now says he will spend the £1million on plastic surgery for his newborn son to give him a normal appearance.
The conflict began after Mr Merlaku won £40million on a slot machine at Casino Bregenz, but was told his win was invalid due to a software error in the machine.
The casino then attempted to resolve the situation by offering him a free dinner.
The casino's spokesman Martin Himmelbauer, 44, admitted the amount had been displayed in the machine but maintained that the machine was faulty and that Mr Merlaku had in fact only won £60.
'We wanted to apologise but he did not want to co-operate. We offered to pay out the cash that he did win, but he refused to accept it.

'Usually these matters are sorted out with a meal for two but in this case the man was not prepared to settle for anything less than the full payment.'
Merlaku's Austrian lawyer Thomas Kerle said Merlaku had accused Casinos Austria of refusing to let independent experts check the slot machine in question. He also criticised the police for doing too little in investigating the case.

The Casino agreed an out-of-court settlement which local media reported was £1million pounds.
The case mirrored that of Louise Chavez who had a similar experience while using a slot machine at the Fortune Valley Casino, in Central City, Colorado.
Chavez thought she had won £20million but after the casino claimed the machine malfunctioned, all Chavez got was a meager compensation of free meals and a room for the night.

If the baby needed the money sooner there are settlement companies that will advance you money on future cases depending on the circumstances.

My dad had a cleft palate and was operated on for £0 in the 1950s. Cleft palate repair is routine and free here in the UK. $1 million seems wrong

Both parties are real cunts in this case.

Baby suffers as a result of stress? Is this proven? If so it goes to show that the husband was well and truly involved in getting a lot of cash for some error in software or a genuine win and his suffered as a result.

The casino is at fault for bribing punters out of cash to win a sum they know will never happen. Its software, its designed to reduce your losses and create more cash flow.

The only problem here is that they didn't expect it to go against them that early, if at all.
