Boy is the media bummed over this.. They were salivating at the jibbs for extradition coverage. I'm sure they had their graphics package and dramatic music all ready to go. And now after days of build up..... Crickets.

Has any one actually read anything about this case? From what I know (I have a law degree & spend far too much time perusing the internet/reading books, articles, etc.. for all there is to know about murder cases), there is no doubt in my mind that both her & her boyfriend are not guilty. They were scapegoats. And the Italian courts should be ashamed at what "evidence" they used to convict them of murder. Perhaps an opinion.. but I'm entitled to it |

The damage from wrongful detention is established by articles 314 and 315 of the Italian penal code: she will get some money for sure, what's sad is that she won't get them straight from the pocket of the judges, but from italian taxpayers' ones. Including mine. The position of Amanda and Raffaele are different tho: Technically, both were wrongfully detained, but despite being cleared of the murder charge, the guilty verdict against Amanda for the slander of Patrick Lumumba (a bar owner she falsely accused of the crime - has been upheld): now all they need to do is the math: days spent in prison by Amanda - days she was sentenced to. At the end of the day, she will get a relatively very little compensation, which can't exceed in ANY case the amount of € 516.456,90. It's half-a million dollars more or less. She will get much less in my opinion, but you never know how things end up un Italy. |
