I have been to many Nascar races and it is printed on the ticket that you go at your on risk. Of coarse, I would expect Nascar to pay for all injuries and give private settlements. Nascar is more worried about bad publicity than anything else. Although where there is a lawyer there is a law suit in the making. |

Not usually. Certainly in the UK your tickets have a clearly printed "Motorsport is dangerous and you are attending at your own risk" kind of disclaimer. Obviously if there was gross negligence involved then someone might be held accountable.

I would be surprised if there is a strong enough case to be honest. The catch fencing is designed to stop a car penetrating it completely - which it did. There have been injuries in the past at events all over the world but as far as I'm aware there hasn't been very many successful lawsuits resulting from them - if any. I can't see how you could put in a claim for injury caused by debris at a race track where you have paid $$ to go watch race cars flying around (sometimes literally) at 200mph+. Unless the fence failed completely, which it didn't. |
