A Billings man has been charged with rape after he allegedly had sex with an unconscious woman he was close to who had just passed out from a seizure.

Matthew Jonathon Jeremy Bartholomew, 36, also faces three misdemeanor charges of assault, destruction of a communication device, and possession of drug paraphernalia.

On Sunday, Billings police were dispatched to Bartholomew’s residence on the 200 block of Rehberg for a reported disturbance.

When they arrived, police found a 29-year-old woman covered in bruises and cuts.

The woman said around 5 a.m. on Saturday, Bartholomew woke her up to have sex and she denied him.

She said Bartholomew attempted to have sex with her again around 9 a.m., but she again said no and he became irritated and began pushing and throwing her.

The victim reported that around 1 p.m. Sunday, she told Bartholomew she felt like she was going to have a seizure and asked Bartholomew to take her to the hospital.

The woman said she has a history of seizures.

She then began having a seizure and once she regained consciousness, she woke up to Bartholomew having sex with her, court documents state.

The woman said she was upset with Bartholomew and asked what he was doing.

Bartholomew then became angry and started hitting the victim, according to the woman.

The woman underwent a sexual assault exam and showed signs of abuse, according to court documents.

Bartholomew was arrested and taken to the Yellowstone County Jail where authorities found a metal pipe in his pocket, court documents state.

Bartholomew said the woman's bruises were from sex that he claimed the victim enjoyed.

Bartholomew made his initial appearance in Yellowstone County Justice Court on Monday afternoon.

He is currently held at the jail on $60,000 bond.
