the Prosecutor in the case has now changed his theory officially. Italian courts are quite different from UK US and French courts...Not familiar with any others enough to say....but THE CHANGE OF THEORY is quite INTERESTING to say the least. |

May I ask you what exactly do you mean for "different from UK US and French courts"? Better? Worse? And why? And what has the court to do with the prosecutor, in Italy? The prosecutor's task is to collect evidences, then to elaborate some theory: if the evidences collected change, also changes the theory. The problem is that for italian law it's important to find the motive of a murder, because to kill for self-defence is quite different from killing someone because she refuses to be raped: in the first case you can be sentenced to some years or even get acquitted, in the second one you can be senteced up to life prison. That's why the prosecutor needs (if possible) to find the motive, hence elaborates theories according to the evidences collected. The court's task is to analyze the evidences collected, to read the reports of the prosecutor, to hear the witnesses, to hear the lawyers, then, finally, to assemble and then, to pronounce sentence. Please, tell me, in France does it work otherwise? And how does it work? And in the UK? And in the US? |
