It's time this was sorted out legally. Getting in a car and driving it is not something you can do accidentally. Therefore it is a DELIBERATE ACT. In legal terms a deliberate act that causes the death of another person is MURDER. Therefore, if you're driving drunk, high, stoned, distracted, using your mobile or anything else that impairs your ability to drive in an appropriate and safe manner and you cause a collision that results in the death or deaths of other people IT IS MURDER. It's time to forget the term "accident." Even police forces no longer use the term "accident." Police officers no longer use the terms "TA" (traffic accident) or "RTA" (road traffic accident) instead using "TC" (traffic collision) or "RTC" (road traffic collision) because they are acutely aware that most crashes are not accidental at all. The fact is that the vast majority of crashes occur because people are deliberately not doing what they should be doing or are deliberately doing things that they should not be doing. With vehicle technology being at the level it is at, fatal traffic collisions should be virtually non-existent. It's time to cut the bleeding heart bullshit "oh it's just an accident" and call it what it is and punish accordingly...

No, murder is the deliberate INTENT *TO MURDER*. Getting into a car doesn't mean you intend to murder anyone. Manslaughter (the non-intentional death) is what you are thinking of. It is only murder if you....INTEND TO MURDER someone. Getting in a car does not equate to intent to murder. You have to prove her intent when she got into the car was actually to commit murder.
