I'm not sure who is in the wrong in this vid, but all I know is that the motorcyclist did a very well executed "controlled bail" to prevent himself getting more injured than trying to avoid the truck.

I would say the bike. Looks like he was speeding. Even if he wasn't you still have to give yourself enough space to stop effectively, especially when you're tailing a large vehicle.
