Re: 2 People on a Bike Slam into a Parked Vehicle

Its a curve. i dont think a sane community would mark that as a parking zone.
the only insane part was the idiot that crashed into a stationary object while going much too fast for a slight curve

where that car was parked was not a problem for anyone who had an ounce of common sense

most likely that car would have been parked legally in the western world and rightfully so

Not sure about where you're from but here in the Philippines, even in the poorest areas, that is just a two opposing lanes with no shoulder for parking (must be newly repaired since there's still no marking). But lane's outside marking would be right where the asphalt ends in the side. parking on that, even if its not a curve will still be illegal and an obstruction. of course, you can expect 99% of people who live in those areas not to heed the rules and do just what pleases them.

I am not saying the rider's are not at fault. They are. extremely. but it doesn't mean the car owner is free from liability.

i'm from a first world country and that car would not be a problem where it was parked, nor could the owner be taken to court if it was legally parked

In first world countries, i think they can also sue the car owner for that rusty obstruction parked in the road. Sort of "they would have negotiated that curve successfully if the car was not there in the first place" argument. and make the car owner pay up.
