Drunk or not, I’d call that self defense. The surfer used his vehicle as a deadly weapon. Hitting him after he was dead is a legally justified double tap.

That cop was a slobbering, stumbling drink and or drug addled maniac brandishing a gun. The biker should have run his bike up the "cops" ass and taken him out. He went for a glancing non lethal "teach them a lesson" side swipe and paid for his mistake with his life.
