Clearly the accident wouldn’t have happened if the van hadn’t tried passing illegally on a solid yellow line, and on a hill where he couldn’t see oncoming traffic. That act is what caused the bike to need to take evasive action, regardless if he made a bad decision, the van caused the accident. |
