Agree. And a couple more points, since apparently so few DRers walk...

1. The intersection had have a red light (w/ "no turn on red sign") or red arrow for that right vehicle lane, in order to enable the ped walk signal. So, the truck was running a red light.

2. Commercial truck drivers have special licenses, rules and training regimes that recognize the limited sight distance. The driver knew the risk and broke the law anyway. For example, the driver would have never seen a wheelchair either.

3. Cities post crossing guards at dangerous crossings like this, because drivers break the law and run the red arrow all the time in right turn lanes. It is the guard's job to occupy the ped xing and block it where the cars normally drive across it. She was doing exactly that.

4. While the guard should have faced traffic, she was clearly scanning across the street to determine if she needed to continue blocking the ped xing for people coming from the opposite side.

5. In many states, guards carry signs and it is state law that vehicles must stop for the sign regardless of what the traffic signal says. Might be a good thing for NYC to modernize its ped laws and equip their guards to increase their protection.

Also bear in mind that the driver is sitting in an elevated position which gives him a greater field of vision. Absolutely no excuse.

I’ve lived in 5 states. I’ve been to around 27 of them for week long work trips. I drive a modest average 90k miles per year. In fucking NONE of them was right on red illegal even when a pedestrian walking sign was active. There are not extra lights that go on to prevent turns when crossing lights are active.

Getting really sick of all the lawyers here who have lived in one place that wasn’t the place where X happened.

and STREETS are for cars!!!! and trucks!!!! not bicycles

I also mentioned that the driver HAD to see the crossing guard when he pulled up to the intersection, and pointed out that the driver is in an elevated position, so at the very LEAST he should have been able to see the hood of the bright yellow slicker of the person standing right in front of him.

And since you didn't specifically mention this magic law that gives truck drivers the right to plow over people, I'm gonna assume you're just being an asshole.
