Looks like an "offensive" high explosive AKA concussion grenade rather than a fragmentation grenade, which is why shrapnel didn't spray down the car, cop and onlookers, frag grenades and be lethal out to dozens of meters.

He may have pulled the pin and be holding onto the spoon. Shooting him would cause it to go off anyway. Might as well try to talk him down, though if it was me I'd like some hard cover between myself and the dude. It could be difficult to tell what sort of grenade it is and the penalty for making a mistake is very high
