Dashboard camera video released on Thursday shows law enforcement gave a robbery suspect multiple chances to surrender prior to being fatally shot on April 27.

A police officer’s patrol car captured a portion of the chase and shooting of Darrel S. Machemehl, 44, after he allegedly robbed a local convenience store at gunpoint.

The video shows the suspect stopping three times on his motorcycle during the 10-mile pursuit on U.S. Highway 90 — at Mill Creek, in the 7900 block of Highway 90 and at the intersection of Farm-to-Market Road 1104.

Each time, the officers can be heard repeatedly asking Machemehl to “put your hands up,” “drop the bag” and “get off the bike.”

“They asked him at least 42 times that we counted, that we could hear on audio, to put the bag down, put the gun down,” Seguin Police Chief Kevin Kelso said. “At one point, he is almost begged by one of the officers to please put it down.”

Starting at about the 11 minute mark in the video and for almost three minutes, officers are heard begging, pleading, asking and commanding Machemehl to give up.

“Just put it down, Bubba,” one officer said. “Put it down. There’s no need for it.”

As he paced back and forth with his hand in his backpack raised up like he had a gun, the suspect is heard yelling at the officers, “Shoot me [expletive]. I have a gun.”

Initially, the incident began at 11:17 p.m. when Machemehl allegedly entered the Pic-N-Pac, located on the southwest corner of State Highway 123 and Interstate 10 access road, brandished an “assault-style” shotgun with a pistol grip, and demanded money.

From the moment officers arrived at the store and saw the suspect, they believed he had a gun on him, Kelso explained.

“When the officers first see him, they see him putting a gun in the backpack,” he said. “From what the officers observed during the pursuit — the trooper who is actually behind him — sees him maneuver for the backpack and believes he is getting a gun.

When he finally stopped, he alludes to or tells the officers that he has a gun and to shoot him, or that he is going to shoot them.”

Officers can also be heard in the video discussing using “less than lethal force,” but Kelso said that wasn’t a viable option.

“He was too far away for the Taser to be deployed,” he said. “They shoot 21 feet. From what we saw, from where they were positioned, where the body came to rest, the Tasers would not have been affective.”

Eventually, at about 13 and half minutes in, four shots can be heard before Machemehl falls to the ground.

“He was shot three times in the torso,” Kelso said. “You can see in the video, he was shot twice and he didn’t go down. The third hit was definitely the debilitating shot, but I don’t know if it was a fatal shot.

One of the other wounds might have caused him to bleed internally, and that one may not have had an impact as far as lethal, but it definitely stopped his threatening manners.”

After Machemehl was secured, officers can be seen using what they had on-hand in an attempt to save his life until EMS arrived.

“We are here trying to protect lives and save lives,” Kelso said. “We are not here to take a life, but when that does happen, we want to do what we can to try to preserve a life.

Unfortunately, there is a time where we have to do what we can to stop the threat. Once those means are exercised, then, the officers use the first aid training and trauma kit they have been provided to try and save that life.”

Seguin Police Officer Mike Guerra was named as the only officer involved in the shooting.

The released video, along with several others and additional evidence were taken to the Guadalupe County Grand Jury in the beginning of May, who found that Guerra was justified in his actions.

Hey forget all those non-lethal weapons you have… shotgun bean bags, tasers, mase hell even an old fashion 10 on one cop beat down. This proves cops love to kill or they are getting very lazy to reach for there non lethal weapons. This is the reason I can't like my brother in law (Glendale cop) he's killed three people now and talks about it like he's cool. Why do people agree with cops killing someone who doesn't drop a bag. Maybe I should start killing people who don't listen to my commands.

I do not know but if you listen right before he gets shot instead of saying bag that cop said drop the gun er..I mean bag.So maybe that has something to do with it.
