Pharmacist Shoots Robber; Pharmacist Charged with Murder
Pharmacist charged with murder - KFOR An OKC pharmacist was charged with murder after surveillance tapes did not match up with his version of the robbery. The events as shown on the video show two men (one armed, one not) in ski masks entering the pharmacy. Two pharmacy chics ran out. The disabled vet pharmacist grabs a gun and shot the 16 year old unarmed boy in the head. Armed robber took off. Pharmacist chased him out into the street. Then, pharmacist ran back inside, grabbed a second gun, and shot the 16 year old 5 more times in the stomach. Medical examiner stated that the gunshot wound to the head was non-fatal, and that the 5 additional shots is what caused the death. DA stated this did not qualify for the "Go ahead, make my day" law. This should make for an interesting case. It's about 50/50 here on the debate whether he should have been charged with murder. |

UPDATE: Three more are charged with murder even though a pharmacist fired the fatal shots that killed Antwun "Speedy” Parker, 16. They will be prosecuted separately from the pharmacist. Those charged are Jevontia Ingram, 14, Emanuel Dewayne Mitchell, 31, and Anthony Devale Morrison, 43. The two adults allegedly stayed outside. They're charged under Oklahoma’s felony murder law, which says a robber, kidnapper, rapist, drug trafficker or certain other felons can be guilty of first-degree murder if someone dies as a result of the crime even if the death wasn’t intentional. D.A. Prater on Wednesday said, "Because of the acts of the defendant we’ve charged in this case, Mr. Ersland, I don’t feel we’d be justified in filing a felony murder charge against the other robber in the case.” Prater said Friday he reversed his position after further legal research. He said no one pressured him to file the new murder case. The boy told police he and his friend, Parker, attempted the robbery after Mitchell and Morrison asked for their help, a police detective reported in an affidavit attached to the charge. The boy said the two men contacted him May 19. Ingram described Morrison as his mother’s friend and Mitchell as Morrison’s cousin. Ingram told police his mother’s friend gave him a gun with no bullets, clothes to wear during the robbery and "advised them what to demand inside the store,” according to the detective’s affidavit. |
