Here's the story... Article Source: Barcelona Informer Spain’s Supreme Court confirms the 26-year sentence for the murderer of Carlos Palomino. The Supreme Court confirmed the 26 year sentence imposed by the Provincial Court of Madrid against Joshua Estébanez as author of the mortal blow which ended, on November 11, 2007, the life of Carlos Palomino in the Madrid Metro, while he was on his way to a demonstration organized by the Youth for National Democracy. In a statement released today, the High Court dismissed the appeal filed by the defence of Estébanez against the sentence handed down in October 2009. He was condemned for the crime of murder with aggravating ideological reasons and attempted murder, he was also guilty of illegal possession of weapons and threatening behaviour. The judges of the Court of Madrid justified the sentence of the defendant, who wore neo Nazi regalia on the day of the incident, captured by Madrid metro surveillance cameras. The High Court concluded that "the attack against Carlos Palomino was premeditated, sudden and unexpected." Since he came on the train, said the ruling, his real purpose was "to attack any of them on the slightest pretext." In addition, he stressed that the stabbing of the two main victims was driven by a 'necandi animus' or direct intent to kill in the first degree, "actions with the specific intention of taking life." At sentencing, the Board rejected that Joshua acted in self-defence and concludes that "the death of Charles was a direct result of the aggression of the accused, made fully conscious, and not probable, but to absolutely end his life". Arriving at the Legazpi station, the defendant noted that the platform was a group of more than one hundred young people, who identified themselves as anti-fascists by their external appearance. The group was boycotting the event for National Democracy. Before the train stopped, he drew his knife while yawning, going quietly to stand beside one of the doors of the car, hiding the knife blade open and upward hoping that some would give him the ‘necessary’ reason to attack one of them. Suddenly, the accused struck him a sharp stab in the chest between the third and fourth left intercostal space with top-down path, which penetrated about three inches to reach the left ventricle of the heart, he died shortly after. Instead of fleeing in the confusion the act generated, Joseph remained inside the train, crossing from one side to the other brandishing a knife at them and uttering phrases like "piece of shit, I'll kill them all "and" Sieg Heil". This last phrase was used frequently in political events in Germany during the Third Reich, and making the greeting of the forces of that time known as the SS, which consists in extending a raised arm, at least to shoulder height. In his statement, he admitted that he stabbed Joshua Palomino in self-defence, to be cornered by the group that accompanied the deceased. |
