No even brand new brakes go out sometimes. There's so many parts that can malfunction with air brakes. Honestly the biker should had waited in line like everyone else and he wouldn't had died. Bikers ignore plenty of traffic rules and laws because they can fit anywhere.
The scooter was doing the safer thing. Nearly 70% of all motorcycle crashes are motorcycles rear ending cars. So obviously it's just better for alot of bikers to just avoid stopping behind a car, because that's hard to accomplish.

In fact some states and nations use that fact to support or implement lane splitting laws.

It's hilarious. Because most bikers I've met don't even realize that's the main purpose of lane splitting laws. They think its because it makes the road safer for bikes, keeps them from being hit by cars. When its really a law implemented to keep cars safe from bikes. Since as the stats show, most bike wrecks are the bike hitting a car, from behind.
