The robber shot the cop about the same time the other guy grabbed him. You clearly see the robber drop the gun on the floor. The cop actually kicks it away from him at one point.

I would say that sounds pretty reasonable. It would be a lot cheaper than paying to put these worthless thugs in prison for who knows how long, only to have them go back to the same way of life when they get out.
