Re: Muskogee Police Officer Fatally Shoots Armed Man
Glad someone brought this up. Yes, the officer did fire additional rounds after the gunman turned his back to him but under a Supreme Court decision, (Tennessee vs Garner), officers are authorized to shoot at subjects fleeing from them if the officer can articulate or circumstances dictate that the offender was or could continue to pose a danger to others. The police were called to the church because the gunman threatened to kill his ex-girlfriend, claiming he had 'a bullet with her name on it'. After he ran from the officer and dropped the gun, he conscientiously chose to return and pick it up, communicated to this officer through his actions that he had no intention of removing from himself the ability to use deadly force against the officer. No, this was a righteous shoot - confirmed by the pastor's own words that the officer did the right thing. |

Re: Muskogee Police Officer Fatally Shoots Armed Man
Great question. In my opinion, if the gunman here either by accident or intent, dropped the weapon that the officer believed he found during his preliminary pat down, then he would no longer have justification to use deadly force against him unless the suspect were to offer an additional threat of violence.

Re: Muskogee Police Officer Fatally Shoots Armed Man
Excellent video and superb shooting by the cop under pressure! 100% justified shooting. You never reach for a gun near a cop. You don't even say the word gun near a cop. Here we're required to notify the police if we get pulled over to let them know we have a concealed weapon. We are taught to say something like "Officer, I have a concealed carry permit and I am carrying." You don't want to say gun and get them on edge, much less pick up a gun when you are being chased by a cop! Gene pool just got a little bit better with this shooting.
